The man charged with the murder of a 31-year-old man in Augusta made his initial appearance in Kennebec District Court Wednesday.

Damik Davis, of New York, did not enter a plea during Wednesday’s initial appearance. Davis was arrested near the scene of a homicide in a fourth-floor apartment in Augusta on Monday.

The victim, 31-year-old Joseph Marceau, was sent for autopsy Tuesday, but police have not released the cause of death. State Police and Augusta Police continue to investigate Marceau’s death.

Davis’ attorney had no comment when asked if his client had any ties to Maine, and had no comment when asked if he thought his client was innocent.

“We fully intend to make sure the state meets its burden of proof, and we intend to show that Mr. Davis had nothing to do with this incident,” said Steve Smith, Davis’ attorney.

Police are still looking for two people: 27-year-old Zina Fritze, and 45-year-old Sean McQuade, who lived in the building, according to police. Davis’ attorney had not comment on if his client knows those two people. They have been missing since Monday.
