A Brooklyn man who ran over and killed an art curator in 2015 while she was out shopping for holiday presents will serve no time behind bars in exchange for pleading guilty, a judge said Wednesday.
Marlon Sewell, 43, copped to a manslaughter charge and admitted to being behind the wheel of a defective vehicle when he struck and killed Victoria Nicodemus on Dec. 9, 2015 while she was walking with her boyfriend on a Fort Greene sidewalk.
In a hearing before Brooklyn Supreme Court Justice Evelyn Laporte, Sewell answered with a soft “yes” when asked by Assistant District Attorney Rene Plattner if a defect in his Chevy Suburban caused him to lose control of the vehicle.
Laporte said that Sewell will receive a sentence of five years probation as a condition of his plea deal.
Sewell could have been sentenced up to 15 years behind bars for the second-degree manslaughter charge.

Sewell previously stood trial on charges of second-degree manslaughter and negligent homicide in 2017.
But Brooklyn Supreme Court Justice Vincent Del Giudice declared a mistrial after it was revealed that a juror overheard one of her colleagues remark that she would “not send a black man to jail.”
The Brooklyn District Attorney’s Office did not end up retrying Sewell and ultimately did not push for jail time.
