Okay, so. This is obviously a move to get Obamacare back before the Supreme Court, now that there is another conservative judge on the team.
The Affordable Care Act, also known as Obamacare, was struck down by a Texas judge on Friday, a move that could suddenly disrupt the health insurance status of millions of Americans. The decision comes amid a six-week open enrollment period for the program.
Texas, along with 19 states, had argued to U.S. District Judge Reed O’Connor that they had been hurt by a jump in the amount of people utilizing state-backed insurance. When Congress cut the tax penalty from the program in 2017, the states claimed, it essentially undercut the Supreme Court’s reasoning for finding former President Barack Obama’s signature legislation constitutional in 2012.
“The remainder of the ACA is non-severable from the individual mandate, meaning that the Act must be invalidated in whole,” O’Connor wrote in a 55-page opinion, according to Bloomberg. O’Connor is a conservative Republican appointee who previously blocked other Obama-era policies.
Last time, the presumed homosexual child-trafficker John Roberts cockblocked the SCOTUS attempt to repeal Obamacare.

During the process of confirming Justice Kavanaugh, Obamacare was talked about a lot. And the general consensus was that he was not opposed to the program in its entirety, but was opposed to the individual mandate.
For those of you who don’t live in America, and so have not yet been forced to know this fact, the “individual mandate” is the requirement that everyone in the country MUST BY LAW buy health insurance from a private company, or figure out a way to get on medicare. The part that is Unconstitutional is that they can deny you medicare and force you to buy insurance from a private company.
As I understand it, if they just put you on medicare by default, and then gave you the option of getting private insurance, it would not be illegal. Of course, then many people would just let themselves revert to medicare without even doing anything, which would amount to a socialized single-payer system, which is financially unsustainable. Ostensibly, the entire purpose of forcing everyone who isn’t poor to buy ultra-expensive private insurance is to cover the costs of poor brown people’s free health care.
Vox has a big article about the details of all of this up right now. I don’t trust Vox, but presumably they understand this Obama stuff better than I do.
This Texas judge is saying that the individual mandate is inseparable from the larger whole of the law.
In 2012, the Supreme Court ruled that the individual mandate was a tax on not having health insurance, because if you don’t buy insurance you have to pay a fine to the government, and the government is apparently allowed to tax whatever it wants, including not having health insurance. It was thus Constitutional. However, in 2017, Trump was able to remove the $700 fine for not having health insurance – which was paid to the IRS – which means that it is no longer a tax, because there is no payment to the government if you do not buy insurance.
So, there’s a double thing here: the law is different than it was when SCOTUS last ruled on it, and we’ve got a new judge.
Trump’s first two years were a legislative disaster. He failed to repeal Obamacare because John McCain voted “nay” to spite him.
He failed on basically everything else, for various reasons, most of which were not his fault.
Using the Supreme Court to get things done while there is a Democrat Congress is probably a good idea. Most of what he wants to do is removing existing laws rather than enacting new laws. So Obamacare can be repealed by SCOTUS. DACA can be repealed by SCOTUS. Birthright citizenship can be repealed by SCOTUS. He can even build the wall through SCOTUS by first ordering the Defense Department to build the wall and then letting that get attacked by a judge and having a judge rule that it is legal for him to build a wall using DoD funds.
This is as good a way as any to get things done. I don’t know if it will actually happen, but Obamacare will be a good test run. Repealing Obamacare was his first attempt at legislation in 2017, so it’s fitting this will be the first case to go to his new Supreme Court.
