Harry Briggs complied completely with the Black thief, but he still just shot him in the head anyway.

Court documents reveal that an anonymous tip from someone who heard Desi P. Thomas Jr. bragging about the fatal shooting of a gas station clerk early last month helped police make an arrest.

Thomas, 22, was charged Wednesday in Marion Superior Court with two counts of murder and one count of robbery resulting in bodily injury, according to court documents. He was arrested Wednesday afternoon.

The prosecutor’s office is also seeking a sentence enhancement because a firearm was used in the crime.

The shooting was reported about 10:18 p.m. on June 4 as Harry E. Briggs, 45, worked his shift at Joe’s Junction, 5220 W. Troy Ave.

A probable cause affidavit states that on the night of the incident, Thomas drove his girlfriend’s car to a spot about two blocks away from the gas station so he could use it as a getaway car. He then entered the store and stuck a Nike shoe in the door frame to keep it from locking behind him.

Once inside, Thomas pressed a handgun against the head of Briggs and ordered him to “be still,” the document states. Both Briggs and another employee were complying with demands when Thomas fired three shots, two of which struck Briggs in the head.

Thomas then took cash from the other employee before leaving the store on foot, the document states. The suspect can be seen “skipping” from the scene in security footage.

Briggs was taken to a hospital where he would be pronounced dead on June 7.

Six days after the shooting, police said they received a tip from someone who claimed Thomas was the shooter. The person told investigators that Thomas bragged about the items he bought with the money he took during the robbery.

Another tip that came just a few days later indicated that Thomas took about $300 from the store and used the money to buy marijuana, a new cell phone and shoes, the document states. The person leaving the tip went on to say that Thomas could be found at his girlfriend’s apartment in the Troy Manor apartment complex.

Police then obtained phone records for a cell number tied to Thomas on social media. The records indicated that the phone was first used the day after the robbery.

Another witness told police that Thomas said that he shot Briggs because the clerk tried to take his gun from him, the document states.
