Ellen Holmes Russell was killed in a head-on collision by a drunk Black driver.

A North Carolina man has been indicted on a second degree murder charge after a fatal crash that claimed the life of a retired Elizabeth City teacher.

Police say 30-year-old Elbert Justin Horton was drunk when he was involved in a head-on collision in Pasquotank County and crashed his 2006 Chrysler minivan into 62-year-old Ellen Holmes Russell’s pickup truck back in December. Russell was pronounced dead at the scene.

Elbert Justin Horton has now been indicted for second degree murder.

According to police, Horton was not arrested immediately because they did not have an arrest warrant.

Horton was processed with the indictment on March 19 and was taken before the Magistrate where he received a secure bond of $250,000. Horton was transported to jail to await his next court appearance.
