A trans man has lost a Court of Appeal challenge against being registered ‘mother’ on his child’s birth certificate.
Freddy McConnell has been fighting to be called ‘father’ or ‘parent’ in a lengthy legal battle, arguing that to force him to be named otherwise is a breach of his human right to respect for private and family life.
The multimedia journalist was able to get pregnant and give birth to the child – named as YY – biologically, legally becoming a man after the child’s birth.
Sir Andrew McFarlane, president of the Family Division of the High Court and the most senior family court judge in England and Wales, concluded that people who have given birth are legally mothers, regardless of their gender, and said there is a ‘material difference between a person’s gender and their status as a parent’.
Three appeal judges upheld Sir Andrew’s ruling on Wednesday.
Imagine a once great country now debating whether someone changes their gender if they chemically and surgically mutilate their bodies to look like a parody of the opposite gender.
Lord Chief Justice Lord Burnett, the most senior judge in England and Wales, sitting with Lady Justice King and Lord Justice Singh, said: ‘The legislative scheme of the Gender Recognition Act (GRA) required Mr McConnell to be registered as the mother of YY, rather than the father, parent or gestational parent.
‘That requirement did not violate his or YY’s Article 8 rights (to private and family life, as enshrined in the European Convention on Human Rights).
‘There is no incompatibility between the GRA and the Convention. In the result we dismiss these appeals.’
“Gestational parent.”

The judges said any change to the law is a matter for Parliament and not the courts. They considered arguments at a Court of Appeal hearing in London in March.
Mr McConnell is a single parent and lives as a man following surgery. He wanted to be registered as ‘father’ or ‘parent’ but a registrar told him that the law requires people who give birth to be registered as mothers.
The Guardian journalist took legal action against the General Register Office, which administers the registration of births and deaths in England and Wales.
The Court of Appeal refused to grant Mr McConnell permission to take his case to the Supreme Court, although he may still pursue an appeal there.
