Justin Greaves was killed while out on his bike, by an intoxicated primate driving a vehicle.

Criminal charges were filed Wednesday against a Bountiful man accused of striking and killing a motorcyclist last fall while intoxicated.

Terrance Desmond Wheeler, 39, was charged Wednesday in 3rd District Court with automobile homicide, a third-degree felony. Prosecutors say he hit and killed Justin Greaves, 39, of West Valley City, at 600 W. 3900 South in the early morning hours of Oct. 18, 2014.

Wheeler was also charged with driving with a measurable controlled substance in the body, a class B misdemeanor, and failure to yield on a left turn, a class C misdemeanor, in connection with the crash.

Terrance Desmond Wheeler already has an arrest record for DUI.

Wheeler’s blood alcohol content was .13 at the time of the crash, according to charging documents. The legal limit in Utah is 0.08.

More than a dozen witnesses told police Greaves was traveling at a normal speed at the time of the collision and a reconstruction of the crash scene supports that he was under the speed limit, the charges state. Police said the motorcycle’s headlight was also on at the time of the crash.

Wheeler allegedly made a late left turn in front of Greaves in an attempt to turn into a convenience store parking lot.

Greaves tried to brake to avoid the collision but was unsuccessful, police said. He died from his injuries at a nearby hospital.
