I’m not a lawyer, but this decision means that Alex Jones can continue operating.
The crisis actors who sued him for calling them out as hoaxing a fake mass shooting are demanding he give them everything he owns for hurting their feelings, and several courts said he should do that, but every judge who has been forced to deal with this since then wants nothing to do with it, and just passes it down the line.
A bankruptcy judge has blocked a proposed settlement between the families of the Sandy Hook elementary school shooting victims who sued conspiracy theorist Alex Jones over his false remarks about the 2012 mass shooting at Sandy Hook elementary school.
On Wednesday, judge Christopher Lopez of the US bankruptcy court for the southern district of Texas said he was unable to approve the proposed settlement between the families and Jones’s bankruptcy trustee. Lopez claimed that their efforts to divide Jones’s assets exceeded his court’s authority.
Bankrupting a man over political statements exceeded the court’s authority.
The initial judgement marked the end of the First Amendment.
If you cannot accuse political actors of lying, what are you allowed to say?
The decision complicates a proposed sale of Jones’s Infowars platform, and could spur divisions between families who sued Jones and won nearly $1.3bn in Connecticut courts and those who won $50m in Texas courts. The two groups of families had proposed a settlement that would guarantee the Texas families a 25% share of Jones’s future payments to the Sandy Hook families, with the Connecticut families taking 75%.
…
Lopez said he blocked the settlement because the families were asking him to divide up assets of Free Speech Systems, the parent company of Jones’s website Infowars, which was dismissed from bankruptcy last June.
In statements prior to Lopez’s order, Jones bankruptcy lawyers, according to the Connecticut Post, said: “The actual goal of this settlement motion is to grab the dividend money before the appellate courts make a decision in the pending appeals, so that if the judgments are reversed there will be no way that Alex Jones may recoup those funds.”
The whole thing needs to be overturned.
Alex never even got a real ruling, he was issued “default judgements” for reasons that (as stated) didn’t even make any sense.
The reality is that if the case had actually gone before a jury, it would have been ruled that Jones had significant reason to believe these people were actors, and even if he didn’t believe that, there is no way to prove he didn’t believe that, and these are public figures who put themselves in the position of being political actors and therefore they do not have strict defamation protections under US law.
In order for something to be “defamation” you have to be lying on purpose. And as was seen with Donald Trump (most of all in American history), if the person you are lying about on purpose is a political actor, it is effectively impossible to be convicted of defamation.
It is very obvious from watching his broadcasts on the topic that Jones actually did believe these people were crisis actors.
Whether you believe that or not, it is obvious that someone could believe it. Especially someone like Alex Jones, who believes every conspiracy (unless it’s related to the Jews).
Just watch any of the conspiracy videos about Sandy Hook.
Maybe it’s wrong, and everything about the shooting was totally exactly as the government said it was. Honestly, I don’t really care either way, because even if kids got shot by some autistic DDR-master, that doesn’t somehow nullify the Second Amendment (or the First!). But if you watch one of the conspiracy videos, you can see how someone would believe it, and therefore it is not viable to claim that anyone who says they believe it is lying because they want to hurt grieving parents who are going on every TV show calling for gun control.
Most of the families suing Jones are Jews.
These are the primary judges who ran the Alex Jones Sandy Hook cases:
The court system in America was designed by honest men to be run by honest men, and when you have Jews and women involved, it simply does not work. If we’re going to have Jews and women’s rights, we are going to need an entirely new Constitution. This situation is otherwise nonviable.
