Well, Supreme Court Justice Anthonin Scalia’s dead.
Supreme Court Justice Antonin Scalia, a tart-tongued champion of conservative interpretation of the Constitution, has died at a West Texas ranch resort, government officials said Saturday. Scalia, the longest-serving justice on the court and its first Italian-American member, was 79.
“On behalf of the Court and retired Justices, I am saddened to report that our colleague Justice Antonin Scalia has passed away,” Chief Justice John Roberts said in a statement.
“He was an extraordinary individual and jurist, admired and treasured by his colleagues,” Roberts said. “His passing is a great loss to the Court and the country he so loyally served.”
This is regrettable.
Scalia was a serious guy, believing in what critics have labeled “originalism” – that is, the the Constitution is meant to be interpreted as the founders intended it.
In the context of United States constitutional interpretation, originalism is a principle of interpretation that views the Constitution’s meaning as fixed as of the time of enactment. The originalist enterprise, then, is a quest to determine the meaning of the utterances, the meaning of which cannot change except through formal amendment. The term originated in the 1980s but the concept resonates with formalist theory and is a special example of textualism.
Today, originalism is popular among some political conservatives in the U.S., and is most prominently associated with Antonin Scalia, Clarence Thomas, and Robert Bork. However, some liberals, such as Justice Hugo Black and Akhil Amar, have also subscribed to the theory.
Originalism is an umbrella term for interpretative methods that hold to the “fixation thesis”—the notion that an utterance’s semantic content is fixed at the time it is uttered.
Obviously, if you abandon historical context, and what the words were intended to mean, you can make it mean anything.
If Obama is able to appoint a liberal Judge, there will be a 5-4 majority which openly espouses a belief in a “living Constitution,” which means that what the founders meant when they wrote it isn’t really important and it can just be changed.
Possibly, the Senate Republicans will be able to hold up the process for a year. It’s definitely within their capacity, but these shills in the Senate has so far failed to do anything at all.
With only 8 members remaining, the Supreme Court is now 37.5% Jewish. Note that the other 6, including Scalia, were Catholic. None of them WASPs. Of course there is nothing wrong with Catholics, but it’s a bit strange. Jews are 2% of the population, Catholics are 22% of the population.
In the coming years, the Supreme Court is going to rule on both the First and Second Amendment. And the goal of the establishment is to shut it all down. These people could actually just decide that the Constitution doesn’t really allow “hate speech” and guns were only meant to be used to form militias to fight King George so we don’t need them any more (that’s their favorite argument, though they also claim that the Founding Fathers couldn’t have predicted the invention of modern guns which are much more efficient than the arms of the period of the nation’s founding).
Ultimately, none of this matters that much, because it is either Trump or bust. If we don’t get Trump, the country is doomed – ZOG is going to start a war with Russia, it’s going to take all freedoms, it’s going to give everything you own to Blacks and foreigners.
When all that’s going down, you won’t care who’s on the Supreme Court.
So my advice would be, don’t pay too much attention to all this SC drama that’s going to drag on for months and months. We’ve got bigger problems.
