Cynthia Jean “Cindy” McKee’s body was eventually recovered in a creek.

A Lockhart man was indicted by a grand jury Wednesday on charges of criminal negligent homicide stemming from a drowning death during the Halloween floods.

Authorities say Willie Brite Jr. deliberately drove his truck onto a barricaded, flooded road in Lockhart on Nov. 2, 2013. The low lying crossing on Polonia Road was covered by several feet of rushing water, and Brite’s truck was quickly fully submerged.

Brite made it out of the truck as it started taking on water heavily, but his passenger, Cynthia McKee, did not.. For weeks, search crews looked for McKee, slow receding waters hindered efforts to locate her body.

Willie Brite Jr
Willie Brite Jr faces up to two years for criminal negligent homicide if convicted.

On Nov. 12, 2013, her body was recovered in the creek.

On Wednesday, a grand jury determined Brite purposefully drove into that area and was therefore responsible for McKee’s death. Brite was also indicted on a DWI felony charge.

He has been charged with DWI and assault in the past. He was also jailed briefly on probation violations stemming from a restraining order placed upon him by a former girlfriend. That former girlfriend accused Brite of killing her children’s pet rabbit after it bit him.

Brite, Jr. faces up to two years for the criminal negligent homicide, if convicted. The DWI felony charge carries a sentence of up to 10 years.
