The man charged for allegedly assaulting a 69-year-old man at the Eastern Market Metro station on April 24 will enter an anger management program, wear an electronic device and be placed under a curfew.
Elijah Smith, 19, appeared in court Friday and was released by a judge after he waived his right to a preliminary hearing, his attorney said, which opened the door for a future plea deal.
Smith was arrested and charged with felony assault for allegedly punching and hitting Albert Langeberg, a Metro rider. The alleged assault was caught on surveillance video.
Langeberg told authorities that he was pushed by the suspected man as he exited a train. The two exchanged words on the escalator before the suspect punched him in the face.
Smith was already on probation for another assault in Silver Springs, Md. in 2014 involving him and three men that assaulted and robbed a well-known theater actor.
