A prosecutor says a one-year jail sentence given to a Novi man who was drunk when his car hit and killed a bicyclist is too lenient.
St. Clair County Prosecutor Mike Wendling said his office is appealing Tommy Taylor’s sentence to Michigan Court of Appeals.
Taylor, 38, was sentenced in March to one year in the county jail and 5 years of probation in the death of 41-year-old Timothy Tacie last June 3 in Port Huron Township.
“We felt the sentence was too lenient given the facts of the case, and the damage caused and the death of the individual,” Wendling said.
Police said Taylor was driving with a blood alcohol content of 0.175 when he struck and killed Tacie, who was riding his bicycle along West Water Street. That’s more than twice the level at which a person can be arrested for drunken driving under Michigan law.
Taylor was convicted in February of operating while intoxicated causing death, a 15-year felony.
During Taylor’s March sentencing, St. Clair County Circuit Judge Cynthia Lane departed from sentencing guidelines — which recommended a minimum of two years, five months in prison — and sentenced Taylor to five years of probation and one year in the county jail, with the possibility of work release in six months.
