The offender looked something like this. That is to say he is the true victim here.
When dealing with Moslems who rape little girls, we have to be sensitive of their cultures.
After last week’s hearing in Skaraborg District Court came on Tuesday judgment in the rape case. Åke Nyqvist Prosecutors had demanded a conviction while the defense held that the indictment should be dismissed.
The young man convicted of child rape. The sentence was 18 months’ probation with specific treatment plan, and he will pay damages totaling 140,000 kronor to the girl.
It is after all a good penalty and I do not intend to appeal the verdict, says Nyqvist.
Spontaneously, I feel that the judgment is wrong, says defense lawyer Tore Brandtler. I do not believe that the evidence is strong enough and I intend to encourage my client to appeal to the Court of Appeal.
Followed by bike
The rape took place on the evening of 20 April in Sjöhagaparken. The 13-year-old girl, her friend and the accused man should have first met on a football pitch in Mariestad.
13-year-old and the accused then switched chat contacts with each other before the girls went into the city. In Ica Taurus parted friends ate and when the 13-year-old was on his way home, the man came cycling and went with her.
Both have stated that they talked to each other in the park, but then separated stories about.
Clung to wrists
According to the description of the crime, the accused have pulled down the girl and held onto her wrists. With violence he will be forced to sexual intercourse with her. The young man says in turn that the intercourse was voluntary.
The man’s own information was not credible enough and we also had a strong witnesses from the girl’s companion. She says that the man was already assertive when they first met, says Åke Nyqvist and continues:
It would be very unlikely if it was the girl who took the initiative for intercourse. It feels good to court the same opinion as me.
Initially, the Public Prosecutor applied for deportation, but he pulled back during the trial.
He had, after all, well established in the country and it went well for him. Then it seemed unreasonable to insist on the expulsion, says Nyqvist.
Unclear whether age
During the negotiations, there has been confusion about the defendant’s age. According to a passport from his home country, the Swedish Migration Board previously relied on, he is 20 years old. According to other documents he will be 16. Even people who for a long time been in the man’s proximity perceive him as younger.
The court considers that the sentence should assume that he was under 18 when the crime. For the commercial part was probation closest to hand instead of imprisonment.
We were in negotiations to present a copy of the birth certificate, showing that he was born in 1999, says Tore Brandtler.
wanted to acquit
Notably, one of the jurors wanted to acquit the man. He felt that there was not enough evidence to establish that the man realized that the girl was under 15 years. Did the man does not think that there has been such a force or coercion that the man can be convicted of rape.
