Congress Passes Law to Make Lynching a Hate Crime

Wait, so lynching was legal until Monday?

Why was I not informed of this?

Congress gave final approval Monday to legislation that for the first time would make lynching a federal hate crime in the U.S., sending the bill to President Joe Biden to sign into law.

Years in the making, the Emmett Till Anti-Lynching Act is among some 200 bills that have been introduced over the past century that have tried to ban lynching in America.

It is named for the Black teenager whose brutal killing in Mississippi in 1955 — and his mother’s insistence on a open funeral casket to show the world what had been done to her child — became a pivotal moment in the Civil Rights era.

“After more than 200 failed attempts to outlaw lynching, Congress is finally succeeding in taking a long overdue action by passing the Emmett Till Anti-Lynching Act,” said Senate Majority Leader Chuck Schumer, D-N.Y.

The bill would make it possible to prosecute a crime as a lynching when a conspiracy to commit a hate crime results in death or serious bodily injury, according to the bill’s champion, Rep. Bobby Rush, D-Ill. The maximum sentence under the Anti-Lynching Act is 30 years.

The congressman said passage of the Emmett Till Anti-Lynching Act “sends a clear and emphatic message that our nation will no longer ignore this shameful chapter of our history and that the full force of the U.S. federal government will always be brought to bear against those who commit this heinous act.”

Actually, lynching was never legal.

What’s more, a lynching hasn’t happened even once in my lifetime. I would assume the last one was probably in the 1930s. So, about a century ago.

That is to say – a lynching hasn’t happened in America in that long. Ironically, they still happen pretty regularly in black countries.

Emmett Till was not actually “lynched” by any normal definition of the term. He was just murdered. He was killed by two guys (the husband of a woman he was harassing and his friend). Lynching typically involves a mob, hence the term “lynch mob.”

In fact, the dictionary definition includes “mob.”

Two people is not a mob.

Honestly, I don’t really know how they get away with referring to the murder of Emmett Till as a “lynching.” I’ve written about this before. Murders happen all the time as a result of a husband having sexual protectiveness over his wife. In most countries that don’t have black or brown people, and therefore do not have gang violence, domestic sexually-related murders are the number one form of murder.

Anyway – whatever. Just more bullshit from the bullshit machine, I guess.

This is basically like passing a law on the purity of snake oil. I don’t even know what the point of it is, other than that these people don’t have anything else to do. I don’t think that they’re claiming that lynchings are happening now, or even trying to imply that.

Also – though I feel stupid even saying this – if there was for some reason a lynching of a black man in the current year, it would already fall under federal hate crimes legislation. So is this law to protect whites from being lynched?

About a quarter of the lynchings that happened in America were of white people. Obviously, most were black, but that’s for the same reason that the majority of the prison population is black – because blacks commit more crime.

There is a clear argument that lynchings in America never really related to race at all. I mean, if 1/4th of the “victims” were white, it’s hard to say it was a race issue. Isn’t it?

If America still had lynchings, it would also still have liveable cities
