Mestizo Deputy Kidnapped and Assaulted College Girls

A former Brazos County constable’s deputy facing charges of kidnap and attempted sexual assault was in court Monday for a hearing on his upcoming trial.

Agustin Rubio, 43, was charged in 2011 with the two offenses, which stem from separate instances involving college-age women he’s accused of coming into contact with while on duty or working an off-duty security job. Both charges are third-degree felonies.

Monday’s hearing laid the groundwork for Rubio’s trial, scheduled for Dec. 9. He could face up to 10 years in prison if convicted.

The former deputy for Brazos County Precinct 2 Constable Donald Lampo turned himself in on Aug. 31, 2011, for the kidnapping charge after police said Rubio handcuffed a woman walking in the area of Fraternity Row and Deacon Drive, then placed her in his car.

Police said the woman was never booked and instead woke up in a parking lot about four hours after a College Station patrol car video recorded Rubio putting her in his vehicle.
