A federal grand jury has subpoenaed former Trump White House counsel Pat Cipollone in its investigation into the Jan. 6 assault on the U.S. Capitol and efforts to overturn the 2020 election, sources with direct knowledge of the matter told ABC News.
The sources told ABC News that attorneys for Cipollone — like they did with the House select committee investigating the Jan. 6 attack on the Capitol — are expected to engage in negotiations around any appearance, while weighing concerns regarding potential claims of executive privilege.
The move to subpoena Cipollone signals an even more dramatic escalation in the Justice Department’s investigation of the Jan. 6 attack than previously known, following appearances by senior members of former Vice President Mike Pence’s staff before the grand jury two weeks ago.
How the hell do you subpoena the White House lawyer?
This isn’t about “executive privilege” anymore at that point – which is something they were arguing about – it’s about basic attorney-client privilege.
This goes back to the fundamental common law. You don’t even have to say “unconstitutional” – you can accuse these people of trying to overturn the Magna Carta!
As far as I know, the only way you are allowed to do this is if you have reason to believe that the lawyer collaborated in a felony. And that is an extremely high standard. Or it was before yesterday.
There is a reason that with every criminal, they don’t just automatically indict the lawyer as an accomplice, even though the lawyer is, by definition, attempting to help the criminal get away with whatever crime he’s accused of.
This is another totally abnormal thing – a completely new thing in America – where the media is acting like it is normal so people just assume it must be normal.
It’s like the secret Nuclear Nancy night-flight to invade Taiwan. The media was reporting on it without saying how bizarre it was to have announced a trip with an implied secret meeting, then have everyone on the internet tracking her plane while she was flying around the Horn of Borneo.
You can do a secret meeting or a public meeting, but a secret-public-surprise-attack meeting is completely new.
Just so: executive privilege and attorney-client privilege are not the same thing.
